There is an express copyright exception in the Copyright Act that allows copying of literary, dramatic, sheet music and artistic works for inclusion in formal examinations. This includes take-home exams.
However, if the examination is
- a practice exam (i.e. not a formal exam),
- being used only as an example of a past exam (i.e. not a formal exam),
- will be copied and made available online for students to access in the future,
then staff will need to comply with the education statutory licence copying limits. For further information about how the limits apply please visit the Teaching and Copyright web page.
Note: There must always be correct attribution (referencing) for any work copied for inclusion in an examination.
