Information on how to enter forms part of the terms and conditions of entry. This competition is offered to participants signing their email to the University of Tasmania database as prospective students interested to student at University of Tasmania. The winner will receive a $5,000 travel voucher via www.tasmania.com and two (2) runners up will each receive a $2,000 travel voucher via www.tasmania.com. Participation in the promotion is deemed acceptance of these terms and conditions. Headings in this document are included for ease reference, and do not affect interpretation in any way.
The promoter is University of Tasmania, (ABN 30 764 374 782) of Churchill Ave, Sandy Bay, TAS (Promoter).
All references to time in this document are a reference to the local time in Hobart, Tasmania, Australia, on the date stated. The promotion commences at 12:01am on 7 April 2019 and closes at 11:59pm on 31 October 2019 (Promotion Period).
Eligibility to enter
Entry is open to SA, QLD, NSW, WA, ACT, NT, VIC and TAS residents (Eligible Entrants), excluding employees and their immediate families of the Promoter and its related bodies.
To enter, Eligible Entrants must provide a valid email address during the Promotion Period
The time of entry will be deemed to be the time the entry is received by the Promoter.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Drawing of entries
The result of the prize draws is final and no correspondence will be entered into.
There will be three (3) prize draws as follows and each will take place at 4pm Friday, 1 November 2019 at Red Jelly, 34-36 Elizabeth Street, Hobart, Tasmania, 7000, on behalf of the Promoter: One (1) major prize draw, (2) minor runners up prize draws. SA Approval of Electronic Drawing System, approval no. 1270.
There will be 3 prizes (2 minor runners up and 1 major prize). The maximum total prize value is up to AUD$9,000, based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prizes. The major prize winner will win one travel voucher for tasmania.com valued at AUD$5,000. The two (2) runners up prize winners will each win one travel voucher for tasmania.com valued at AUD$2,000.
All vouchers will be issued within 7 days of the major prize draw and distributed to the winners via electronic mail by the Promoter.
The major prizes are not transferable and cannot be taken as cash.
The images depicted in all promotional materials are not necessarily the same as the tour options offered by Tasmania.com.
Prizes are not exchangeable or redeemable for cash or other goods or services. There can be no changes made to travel arrangements once travel vouchers are issued. If the prize is not utilised within six months of issue date, it will be forfeited. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to legislative approval from all necessary government authorities.
Notification of winners
All winner(s) will be notified by email within two (2) business days. All winners' initial, surname and state for each draw will be published in The Australian newspaper on 8 November 2019.
If for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited. Unused elements of the prize will not be reissued or replaced. If the winner notifies that they are also unable to take the prize, the prize will be forfeited. Right of the Promoter to redraw
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For each prize that remains unclaimed on 1 February 2020 from the original draw, a redraw will be held on 3 February 2020 at the same time and place as the original draw, subject to a legislative approval from all necessary government authorities. Any winners determined in accordance with this clause will be notified by email by 5 February 2020 and their names will be published in the Australian newspaper on 10 February 2020.
Limitation of liability and variation of terms
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to legislative approval from all necessary government authorities) to cancel, terminate or modify or suspend this promotion.
The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
The exclusion of liability in clause 19 does not apply to limit or exclude liability:
for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter's [Conditions of Carriage and general booking conditions] (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
Entry details and privacy
Entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement (PDF 342 KB). All entrants consent to the Promoter using the entrant's name, suburb, likeness and/or image in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. Entry is conditional on providing this information and an entrant cannot enter the promotion without it. The Promoter may for these purposes disclose such information to third parties, including, but not limited to, prize suppliers and other partners of the promoter and as required, to Australian regulatory authorities. Entry details remain the property of the Promoter.
The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
