Introduction

Students are required to complete a law faculty moot in their final year of an LLB degree.

The moot is a practical exercise involving extensive preparation of a moot problem set on a particular area of the law. Working in pairs students are required to prepare a Written Submission which will consist of a number of legal submissions on the moot problem which will then be presented as oral arguments before a panel of judges. The judges will include legal academics, legal practitioners and members of the Tasmanian judiciary.

Subject areas for the moot may include Contract,Tort,Criminal Law,Environmental Law and so on. The moots are held on selected dates each semester in the Supreme Court of Tasmania.Students are required to present their legal submissions and arguments to the judges for 20 minutes during which time they may be asked questions and cross-examined on their submissions

Students must register for their moot where they may choose a partner and indicate a preference for their moot topic.Prior to the moot students must attend a one hour lecture on aspects of legal advocacy these include detailed instructions on preparation for the moot, principles of advocacy and how to construct the written submission.

As this is essentially a practical exercise in legal advocacy no final result I’m terms of marks or grade are allocated for this unit but students will be given a mark out of 100 for their moot performance and are required to obtain a mark of 50% to satisfactorily complete the unit.Students will also be provided with feedback from the judges at the conclusion of the moot and written comments on performance will be provided.
