Kate Warner is an Emeritus Professor of Law at the University of Tasmania where she taught Criminal Law and Criminology before her appointment as Governor of Tasmania in December 2014. She was Director of the Tasmania Law Reform Institute from 2002 until 2014. She has served as Dean of the Faculty of Law and Head of Department in the Law School and on numerous boards including the Sentencing Advisory Council (Tasmania). She is a fellow of the Australian Academy of Law and a fellow of the Australian and New Zealand Society of Criminology.

Biography

Kate graduated from the University of Tasmania receiving an honours degree in law in 1970 and an LLM by thesis in 1978. She began working full time as a lecturer in the Law Faculty in 1981 and was promoted to Senior Lecturer in 1989, Associate Professor in 1993 and to Professor in 1996. She was the first woman Dean of the Law Faculty (1992-1994) and was Head of School from 1994-1997. In 2012 she was a awarded the Distinguished Service Medal at the University of Tasmania and was made a Companion of the Order of Australia in 2016 for significant service to the law.

She is a national and international recognised expert in sentencing in Australia. This recognition is based on her outstanding publication record and awards. In 2006 Kate was awarded the Allen Austin Bartholomew Award for the best article in the Australian and New Zealand Journal of Criminology. Her book, Sentencing in Tasmania (2002) is used daily in Tasmanian courts in sentencing submissions.

Administrative expertise

Kate was the foundation Director of the Tasmania Law Reform Institute from 2002 to 2014 during which she oversaw some twenty projects. Collaboration

Kate has collaborated with scholars from the Max Planck Institute for Comparative Criminal Law and Criminology in Freiburg on two projects and book projects with scholars from Oxford University. Currently she has a partnerships with a number of Australian bodies in a linkage grant including the Victorian Sentencing Advisory Council and the ACT Victims of Crime Commissioner.

Current projects

Kate's most recent research seeks to address the significant problem that arises when misconceptions about public opinion lead to costly and ineffective policy responses by governments. This research uses a novel and innovative method to gain a better understanding of the complexities of public perceptions about sentencing and criminal punishment that can in turn inform criminal justice practices and avoid the unnecessary social and economic consequences of harsher sentencing.

Public opinion polls suggest that sentences are too lenient and judges are out of touch leading to pressure for costly punitive sentencing regimes. While alternative research methods (e.g. vignettes) suggest that surveys exaggerate public punitiveness, they can lack credibility with the public and politicians as well as real world validity. Two current ARC projects are using jurors in real cases to inform judgements on sentencing issues. They build on a smaller Criminology Research Council project which used a sample of Tasmanian jurors (see for an overview of findings: http://www.aic.gov.au/publications/current%20series/tandi/401-420/tandi407.html) . The outcomes will be greater insights into the contradictions and complexities of public perceptions about sentencing to inform judicial practice and policy developments, thereby avoiding costly and ineffective policy responses and improving public confidence in the criminal justice system.

Publications

Kate's most significant contributions to sentencing scholarship include journal articles and book chapters on sentencing including the 'Sentencing Review' for the Criminal Law Journal, published annually since 1998.

Kate has made significant contributions to law reform bodies over many years including on sexual assault law reform and on sentencing issues, starting with researching and writing papers on fines for the Tasmanian Law Reform Commission in the 1980s, the Sentencing Final Report for the Tasmania Law Reform Institute in 2008 and assisting the New South Wales Law Reform Commission and the Australian Law Reform Commission with sentencing references. In 2010 she was appointed a member of the Tasmanian Sentencing Advisory Council and has actively assisted with its work and has jointly authored a research paper for the Council.

Kate sits on the editorial boards of leading academic journals, including the Current Issues in Criminal Justice, as well as Women Against Violence: A Feminist Journal, Criminal Law Journal, and the Bond University Law Review. She has reviewed articles for Criminal Law Journal, the University of Sydney Law Review, the Melbourne University Law Review, the University of New South Wales Law Review, the Australian and New Zealand Journal of Criminologyand for theNew South Wales Bureau of Crime Statistics and Research.

Grants & Funding

Kate has secured over $1 million in competitive research grants over the last 10 years including four ARC grants, three as first named Chief Investigator. In addition she was first named Chief Investigator on a successful grant from the Criminology Research Council in 2006. She has also received seed funding from the Australasian Institute of Judicial Administration (AIJA) which led to the successful Linkage Grant in 2013 with the AIJA as a linkage partner. She has collaborated with government departments in much of her research. Kate has also successfully applied for Law Foundation funding to provide additional support for a number of projects for the Tasmania Law Reform Institute.

Judges' work, place and psychological health - a national view (2022 - 2025)$540,000

Description: Judicial officers regularly adjudicate cases of appalling human depredation, sometimes leading to extreme levels of work-related psychological harm, implicated in recent suicides. The project builds on team members' research into the prevalence of traumatic judicial stress, drawing on state and territory judges' experiences for an evidence-based understanding of judicial stress in terms of individual and institutional challenges. It will create a targeted, robust foundation for enhancing the judicial decision-making environment through improved wellbeing and resilience, easing the human toll on this highly specialized workforce. This research will support justice goals, reduce costs from judicial stress and increase courts' effectiveness.

Using jurors to gauge informed public opinion on sentencing. (2013 - 2015)$400,000

Description: Public opinion polls suggest that sentences are too lenient and judges are out of touch leading to pressure for costly punitive sentencing regimes. While alternative research methods (e.g. vignettes) suggest that surveys exaggerate public punitiveness, they can lack credibility with the public and politicians, as well as real-world validity. This project will use jurors in real cases to inform judgements on sentencing issues. The outcomes will be greater insights into the contradictions and complexities of public perceptions about sentencing to inform judicial practice and policy developments, thereby avoiding costly and ineffective policy responses and improving public confidence in the criminal justice system.

Gauging informed public opinion on sentencing sex offenders: a national study (2013 - 2016)$252,125

Description: The media consistently claim that the public wants tougher sentences for sex offenders and politicians often respond by passing punitive sentencing measures like mandatory penalties. While general public opinion surveys support the claim that sentences are generally too lenient, more sophisticated research suggests that the existence of a punitive public is a myth and is largely the product of the way these surveys are conducted. However, there is a lack of research on how informed members of the public view the seriousness of sex crimes. This national study aims to remedy this lack and assist public policy makers and sentencing judges by using jurors in sex offence trials to explore and compare public preferences across Australia.
