Some of the impacts of climate change are inevitable and we are going to have to adapt. In Australia, 80% of the population lives within 50km of the coast. Sea levels will rise. There will be increased erosion. We will have greater need to manage bushfire risk and larger demands on emergency services. How we respond to these changes is important for the future of communities, economies and the natural world.
Exploring a legal framework for climate change resilience
Professor of environmental law, Jan McDonald, is exploring the role that law can play in helping us to adapt to the impacts of climate change.
'There is an incredible amount of policy effort focused on reducing the impacts of climate change by reducing emissions, and this is vital. There is also a real need to prepare for the impacts that now seem inevitable, and there is currently less focus here,' said Professor McDonald.
'Adaptation to climate change will demand a multifaceted approach including technological solutions, economic incentives, community education, and legal interventions. The law will be an important tool for promoting resilience to change, but designing it appropriately requires care.'
Professor McDonald has pioneered the field of climate adaptation law in Australia.
'The Law is steady and certain. It evolves slowly, and typically can't respond well to radical change. The impacts of climate change will require some laws to effect transformation.'
'I am pleased to have raised the profile of this area. A one-size-fits-all approach will not work. We will need to create a legal framework to cope with climate change, not wait for the law to adapt. If we wait, it will be too late.'
Professor McDonald says the law will become more important as the competing adaptation priorities between ecosystems and communities become apparent.
'One of the key benefits of progress in this field will be the protection of coastal assets and biodiversity, which has great economic, spiritual, intrinsic and cultural value,' said Professor McDonald.
'As humans respond to the impacts of climate change, we have to ensure that we do not displace other species who are themselves adapting to environmental change. For example, the increased use of firebreaks to protect development in fire-prone areas will reduce important habitat for animals.
'We also need to protect the areas that animals are going to need to migrate to when coastal erosion happens. We can identify the areas that are going to be important future habitat now, and the law should ensure that it is protected.'
Another benefit is reducing businesses' exposure to future liability.
'Businesses cannot afford to ignore the potential impacts of climate change. The most expensive developments are often built on the coast. While increased regulation now might seem like a hand brake, in 100 years, the owners of developments in affected areas may think differently in hindsight.'
By establishing where the law fits into the range of interventions required today, Professor McDonald's research may help prepare us for the impacts of climate change tomorrow.
Jan McDonald is the New Star Professor of Environmental Law in the School of Law. Her current research spans the legal and policy dimensions of climate change adaptation, including urban planning and coastal management, liability and insurance issues, and the application of resilience thinking to law. Professor McDonald is President of the National Environmental Law Association and was a Contributing Author to the IPCC's Fifth Assessment Report. She has consulted to local, state and national governments on environmental and climate change adaptation issues, and has taught, researched and published widely across a range of environmental law issues. Professor McDonald has won over $3million in research funding, including three competitive grants relating to climate change adaptation since 2011.
Biography
Jan McDonald is the New Star Professor of Environmental Law. She has consulted to local, state and national governments on environmental and climate change adaptation issues. In 2004-2005, Jan served as Environment Program Manager for the United Nations Development Program's Pacific office, in Solomon Islands and has served as a consultant to the Government of Vanuatu and Solomon Islands, as well as several environmental non-government organisations.
Since her arrival in Tasmania and the Faculty of Law in 2011, Jan has won three competitive grants relating to climate change adaptation and was appointed to the Tasmanian Climate Action Council in 2012. Her current research spans the legal and policy dimensions of climate change adaptation, including urban planning and coastal management, liability and insurance issues, the application of resilience thinking to law.
Jan McDonald has taught, researched and published widely across a range of environmental law issues. Before coming to Tasmania, she was Director of the Griffith Climate Change Response Program and Professor of Environmental Law and Policy in the Griffith School of Environment. In 2007, she led Griffith University's successful bid to host the National Climate Change Adaptation Research Facility and served as NCCARF Establishment Director in 2007-2008. She also led Griffith University's role the South East Queensland Climate Adaptation Research Initiative (SEQ-CARI) - a partnership between the Queensland and Australian Governments, the CSIRO Climate Adaptation National Research Flagship, Griffith University, University of the Sunshine Coast and University of Queensland.
Jan is President of the National Environmental Law Association and has served as a member of the Tasmanian Climate Action Council. She was a Contributing Author to the IPCC's Fifth Assessment Report.

Expertise
Jan has researched and published widely on a range of environmental law issues. In recent years, her research has spanned the legal and policy dimensions of climate change adaptation, including urban planning and coastal management, liability and insurance issues. Jan has consulted to local, state and national governments on environmental and climate change adaptation issues and has worked closely with Clarence Council to identify the legal issues arising from various adaptation options.
Since arriving at the University of Tasmania is 2011, Jan has completed projects supported by three competitive grants relating to climate change adaptation, relating to spatial planning instruments, coastal adaptation and the status of adaptation research. New projects explore and test the application of resilience thinking to the legal challenges posed by the Anthropocene.

As a specialist in environmental law and a member of the Centre for Marine Socio-Ecology, Jan's research aligns with both the Environment, Resources and Sustainability and the Marine, Maritime and Antarctic University of Tasmania research themes.
