Communication of copyright material and performances is an exclusive right of the copyright owner. "Communicate" has a defined meaning within the Copyright Act 1968. It means to "make available online or electronically transmit (whether over a path, or a combination of paths, provided by a material substance or otherwise)." It therefore applies to supplying material by email and making it available online (whether by restricted access or otherwise).
