Professor Margaret Otlowski is focused on the relationship between the law, health and ethics. She is passionate about protecting people from harm in this era. Reviewing laws, and recommending change in light of new ethical questions is a fundamental aspect of her work.

When health technology and ethics collide: reviewing and updating the laws that protect us from discrimination and harm.

How would the philosophers of the Enlightenment have reacted if they could see into the future and how we live in this millennium? The Age of Reason, which began in their lifetime, triggered rapid technological innovation. Technology has been the catalyst for some profound philosophical and ethical questions, and it continues to be. We can map someone's DNA from a single hair, perhaps without his or her knowledge or consent. Genome sequencing will soon become the norm. Robots may have the potential to wage wars. We can keep people alive in hospitals even when their bodies and minds are incapable of surviving on their own. We can keep people alive against their will. How do we reconcile the clash of technology and ethics that progress has bestowed on our generation?

Technological advancement is so rapid that the law can be slow to respond. What legal mechanisms can be brought to bear to protect humans from the implications of technology?  Who grapples with the ethical questions that our ever-changing technological environment presents?

Professor Margaret Otlowski is focused on the relationship between the law, health and ethics. She is passionate about protecting people from harm in this era. Reviewing laws, and recommending change in light of new ethical questions is a fundamental aspect of her work.

'When technology enables unethical practices to occur, our laws need to be revised to protect people from harm,' said Professor Otlowski. 'To be able to have a tangible impact on policy or law reform through my recommendations is very rewarding.'

'Issues such as euthanasia and the regulation of information regarding genome sequencing demand consideration. How should our laws respond to these changing circumstances?'

Professor Otlowski feels strongly about changing the laws in relation to euthanasia. Her PhD thesis on voluntary euthanasia was so highly regarded that it was made into a book published by Oxford University Press, Voluntary Euthanasia and the Common Law 1997.

'Euthanasia is an example of how technological developments demand a rethink of the law. I still feel passionate about it. Even genetics, a field that can help us so much, raises issues around discrimination and consent.'

Professor Otlowski has served as expert and high-level policy advisor to the government as member of the Australian Health Ethics Committee (AHEC) and the Human Genetics Advisory Committee (HGAC), both of which are Principal Committees of the National Health and Medical Research Council (NHMRC).

Professor Otlowski was appointed chair of the working group responsible for rewriting the chapter on genetics in the NHMRC's National Statement.

By obtaining a strand of someone's hair, it is possible to assess their DNA without their knowledge or consent. Professor Otlowski has produced papers on protecting people from non-consensual genetic testing.

'The possibility of someone's genetic sequence being made available raises a range of ethical questions depending on who has access to this information,' said Professor Otlowski.

How does the law operate in regards to controlling access to someone's genetic sequence? There are considerable grounds for discrimination and the breach of human rights.

'To establish the need for law reform regarding discrimination and consent in relation to genetic testing, we need to understand the viewpoints of the people we are assessing,' said Professor Otlowski. Her genetic discrimination research has involved input from key stakeholders involved in the field of genetics.

'We have surveyed patients who have undergone genetic testing, the insurance industry which has a vested interest in knowing the results, and employer groups' attitudes to genetic testing. It is important to assess these kinds of ethical dilemmas at the coal face.'

'The Tasmanian Law Reform Institute (TLRI) is part of our identity at the Faculty of Law,' said Professor Otlowski. 'It has helped to imbue a tradition of thinking about law reform among our staff and students.'

Margaret Otlowski is a Professor of Law at the School of Law in the College of Arts, Law and Education and Deputy Director of the Centre for Law and Genetics. She holds an adjunct professorial appointment with the Menzies Institute for Medical Research. Her research has focused on health law. She was Dean of Law from 2010-2017 and Pro Vice Chancellor (Culture, Wellbeing and Sustainability) from 2018-2020. She has been admitted to practice and has been a part-time member of various Commonwealth and State Tribunals including the Social Security Appeals Tribunal, the Tasmanian Anti-Discrimination Board and the Tasmanian Guardianship Board. She was made a fellow of the Australian Academy of Law in 2015. She has also served on a range of national and state committees.

Biography

Margaret graduated in 1985 with First Class Honours in Law. After completing the Legal Practice Course, she did her articles with Page Seager solicitors in Hobart and was admitted as Barrister and Solicitor in 1986. After some part-time lecturing involvements, she was appointed in a full-time academic role at UTAS in 1987. She completed a PhD in 1992 which was published in the UK by Oxford University Press (Voluntary Euthanasia and the Common Law). Since then, she has pursued her career through the University of Tasmania and was appointed Professor through a Personal Chair in 2003. Margaret has served in a range of roles at UTAS, including as Dean of Law 2010-2017, Pro Vice Chancellor (Culture, Wellbeing and Sustainability) 2018-2020, Vice Chancellor’s Envoy (Europe) and Senior Academic Adviser, Graduate Research (2021).

Her principal areas of research expertise are in relation to end-of-life issues and aspects of law and genetics, with particular focus on genetic discrimination, privacy and regulatory issues. She has taught across a number of areas including Family Law, Torts, Law and Ethics of Health Care, Biotechnology Law and more recently Ethics, Social Responsibility and the Law and Foundations of Law. She was an inaugural recipient of a UTAS Teaching Excellence Award in 1992 and has also been awarded a Teaching Merit Certificate.

Margaret has taught across a variety of units over the course of her career, including Labour Law, Employment Law, Family Law, Torts, Law and Ethics of Health Care and Biotechnology Law. Since concluding her Deanship role, during which she had limited teaching involvement, she has coordinated LAW181 Ethics, Social Responsibility and the Law and has taught into Introduction to Law units (Legal Systems and currently LAW107 Foundations of Law). She has been responsible for unit design of many of these units.  She has also been involved in teaching health law and ethics topics to medical students.

Margaret uses doctrinal research methods and critical legal analysis to examine laws and practices in health care and research to evaluate their effectiveness and identify areas for reform or where new forms of regulation are required. This is also sometimes supplemented with empirical research methods including surveys and interviews. She partners with academics and practitioners in law and health related disciplines and has received public funding to address particular legal-ethical challenges arising from technological developments in health care. This has included focus on beginning of life (artificial conception, surrogacy) and end of life issues including voluntary assisted dying. Over the last two decades, her research has focused predominantly on legal and ethical issues raised by technological developments with genetic testing and more recently genomic sequencing.

Through her books, chapters, articles as well as submissions to public inquiries and presentations she provides insight into contemporary challenges in these areas and guidance on law and policy through recommendations for reform. Her work is frequently cited and has been influential in shaping law and policy in her key areas of expertise.

Collaboration

Margaret frequently collaborates with researchers from law and other disciplines in Australia as well as the UK, US and Canada. She is the Australian representative for the Expert Panel for the International Genetic Discrimination Observatory which involves collaboration with researchers from across the globe.

Margaret has been Chief Investigator on numerous grants with funding from ARC, NHMRC and Genomics Health Future Mission, involving collaborations with a range of partners including University of Sydney, Monash University, University of Melbourne, Swinburne University, University of Western Australia, Garvan Institute, Children’s Cancer Institute and Kids’ Cancer Centre. Internationally, she has collaborated with researchers from a range of institutions including HeLEX at Oxford, University of Toronto and University of Alberta, Canada and University of Iowa and University of Indiana in the US.

Publications

Margaret has published extensively in the field of health law and ethics, including a book with Oxford University Press (UK) (Voluntary Euthanasia and the Common Law 1997), a number of monographs, book chapters and more than 100 peer reviewed journal publications.

Margaret publishes in peer reviewed law journals as well as biomedical, bioethics and social sciences journals, reflecting the inter-disciplinary nature of her work. Given the strong focus on law and policy reform in Margaret’s work, she also endeavours to disseminate her research through other channels. This has included numerous written submissions to law reform bodies and public inquiries as well as providing oral evidence on invitation. She has also authored/co-authored various consultancy reports for national and state bodies including the HMRC (Biobanks Information Paper, 2010) and the National Bioethics Consultative Committee, Discussion Paper Surrogacy, Implementation, October 1990.

Margaret has been a member of a number of Editorial Boards, including the Australian Journal of Family Law 1999-2021; Australian Health Law Bulletin 1998-2013; Journal of Bioethical Inquiry 2006-2013; Australian Journal of Labour Law 1992-2008; and AGENDA: A Journal of Policy Analysis and Reform 2004-2006. She has also acted as referee for numerous journals to review manuscripts in health law and ethics.

Grants & Funding

Together with colleagues from the Centre for Law and Genetics, Margaret has had a successful history of securing grants with the Australian Research Council, the National Health and Medical Research Council and more recently, through the Medical Research Future Fund, Genomics Health Futures Missions, ELSI Scheme.

Margaret has been a Chief Investigator (including first-named) on numerous large Australian Research Council and NHMRC Project grants examining the ethical, social and legal aspects of the new genetics/genomics. This has included collaborative projects on biobanking and personalised medicine

A significant project which she led was the ARC funded Genetic Discrimination Project (2002-2004); an inter-disciplinary exploration of the phenomenon of genetic discrimination in Australia undertaken with Dr Sandy Taylor and Dr Kristine Barlow-Stewart. This research team was the first to design a research study in this field involving a third-party verification component which led to verified data on instances of genetic discrimination in Australia. This study attracted significant interest nationally and internationally and led to a number of high impact publications.

This project comes within the ELSI (Ethical, Legal and Social Issues) stream of the Genomics Health Futures Mission funding. It seeks to address an evidence gap - to monitor the impact of the moratorium on life insurers' use of genetic test information for insurance underwriting purposes. In doing so, it directly addresses the issue of genetic discrimination which has had a deterrent effect in Australia for the uptake of recommended clinical genetic testing as well as participation in genetic/genomic research.

This project will seek to answer the following question: Does the Australian legal framework provide sufficient clarity for clinicians, researchers, the public health system and those making requests, to deal with requests for the return of raw genomic sequence data to patients and research participants? It incorporates an interview-based component that will then be used to consider how requests for raw genomic data by patients and medical research participants are likely to be treated from a legal perspective. It will produce a set of recommendations and best practice protocols.

From Discovery to therapy in genetic eye diseases (2017 - 2021)$2,498,223
Description
Ophthalmology has always been at the forefront of genetic discovery and this has led to an improved understanding of the biological mechanism of manyinherited eye diseases. This CRE brings together leading researchers from all the genetic eye disease groups across Australia to capitalize on the newtechnologies in ocular imaging and genetic discovery. The research team has a strong track record in identifying and characterising genes that cause bothMendelian and complex blinding eye diseases and in translating these findings into clinical care. Building on our previous experience and using new imagingtechnology such as optical coherence tomography, adaptive optics and micro-perimetry we will progress research to precisely define the natural history ofblinding eye diseases. This is essential for clinical trials to proceed efficiently. Access to a national network of patients and families with specific geneticsubtypes of eye diseases will enable us to facilitate and initiate treatment trials for inherited ophthalmic conditions. In conjunction with patient andcommunity organisations we will develop world leading models for genetic risk prediction and for feedback of genetic results for both Mendelian andcomplex eye diseases. Our work will extend to analyzing health economics as well as the legal and ethical aspects of genetic research. Central to the CRE willbe the training of researchers and eye care providers to develop best clinical practice using our research findings. Our team members are experiencedparticipants in international consortia for eye disease gene discovery; Australia's national disease registries and biobanks place us in a key position to alsoparticipate in international gene based treatment trials for a large number of disorders. Translation of this research into care for genetic eye disease ispredictive, preventive, personalised and participatory.

Implementation of Genomics into Queensland healthcare: ethical, legal and social implications and policy challenges (2017)$218,709

The explosion of genomic technologies offers the promise of revolutionising healthcare, but these new approaches to diagnosing and treating disease bring with them a host of ethical, legal and social and policy complexities. This application brings together a world-class team of scientists, legal experts, ethicists and physicians who will work together to develop protocols and policies within 6 themes: i) community engagement; ii) consent; iii) genomic research; iv) justice; v) clinical use of genomics and vi) health systems. The overall aim of the project is to ensure the safe delivery of genomic medicine for the people of Queensland.
