Dr Olivia Rundle is senior lecturer in Law in the College of Arts, Law and Education. Dr Rundle's work includes research, teaching and community engagement in the three broad areas of family law  dispute resolution and civil procedure. Olivia has held several leadership positions within the Law School. She is actively involved in the broader legal, dispute resolution and research community.

Biography

Olivia has worked at the Faculty of Law in research since 2001, when she commenced working as a graduate research assistant. She completed her undergraduate and postgraduate degrees at the University of Tasmania. She was admitted to legal practice in 1998, worked in legal practice until 2000, and has worked as a Family Dispute Resolution Practitioner registered by the Attorney-General and a Mediator accredited under the Australian National Mediation Standards. She started teaching in the Faculty of Law in 2004. She has been a full time academic since November 2009.

Expertise

Olivia critiques the law’s capacity to reflect and support diverse identities, family relationships and changes in family life. Olivia’s research also explores the possibilities for the legal profession engaging in dispute resolution processes, in connection with and outside the formal justice system. An excellent collaborator, Olivia works with a range of academics, practitioners and organisations. Olivia’s work is cited widely, and the impact it has on the legal profession is illustrated by her work being cited in speeches given by members of the judiciary.

Collaboration

Olivia works with a range of research collaborators across UTAS, the Australian legal academy and dispute resolution field. She believes in fostering meaningful connections with academics who share her interests. She is a founding and actively contributing member of the Australian Dispute Resolution Research Network and participates in annual gatherings of Civil Justice researchers and teachers. She has convened gatherings of both groups and plays a leadership role in supporting the development of quality research and teaching activity nationally.

  • De facto relationships in the Family Law Act 1975 (with Dr Michelle Fernando, University of South Australia)
  • Conflict in supervision relationships between supervisors and research higher degree candidates (with Associate Professor Samantha Hardy, James Cook University and Professor Lisa Toohey, University of Newcastle);
  • Contracts and disputes around retirement living (with collaborators from CALE including law, housing and social science).

Publications

Olivia’s primary contributions to knowledge have been in two distinct topic areas: legal recognition of personal relationships; and lawyers’ engagement in dispute resolution processes. She also engages in scholarship related to legal education. In addition to many peer reviewed journal articles, she has co-authored two research books: Mediation for Lawyers (CCH, 2010) and Sex, Gender, Sexuality and the Law: Social and legal issues faced by individuals, couples and families (Thomson Reuters, 2016). Her most cited publication is ‘Barking Dogs: Lawyer Attitudes Towards Direct Disputant Participation in Court-Connected Mediation of General Civil Cases’ (2008) 8 QUTLJJ 77. Olivia is approached regularly to work with others, who appreciate her collegial and collaborative working style and ability to apply her expertise to a range of contexts.

Drawing together legal and management expertise to develop practice guidelines for lawyers and HR managers about organisational obligations re providing a psychologically safe workplace (2016)$5,666
Description
The project will utilise legal and management expertise within the team in order to explore the question of what exactly managers should do in order toavaoid liability for workplace psychological injuries and what they are required to do to meet their 'reasonable accommodation' requiremeht under anti-discrimination and Occupational Health and Safety law. Essentially it will involve a cross-disciplinatry translation of knowledge and materials to produce resources that will be useful for professionals, academic teachers and researchers.
