Introduction
The aim of this unit is to explore some key issues of principle in criminal justice, examining aspects of the criminal law and wider developments in criminal justice. Three clusters will provide the focus of the unit. The first cluster examines certain constitutional and human rights principle relating to the presumption of innocence. The second cluster examines the extent to which the criminal law can properly be used to enforce positive duties of the citizen. The third and most substantial cluster examines the preventive turn in criminal justice, looking at the ways in which conduct is criminalized for preventive purposes, and other ways in which coercive measures are justified on grounds of prevention. The essential method of the unit will be to reflect on issues of principle relating to each of the topics, exploring their connections with deeper moral and political principles.
