This unit involves Criminal Law. It is strongly recommended that students only enrol after they have successfully completed EITHER (LAW351 Criminal Law A and LAW352 Criminal Law B & Criminal Procedure) OR (LAW225 Criminal Law A and LAW226 Criminal Law B). Students who enrol without first completing these units do so at their own risk.

Introduction

Seeks (a) an understanding of the law relating to sentencing of offenders and the range, nature and efficacy of sentencing options; and (b) to evaluate critically sentencing law and policy. The unit studies the law and practice governing the sentencing of offenders including: the general sentencing principles enunciated by the courts; procedures at the sentencing stage of a criminal trial or hearing; mechanisms of appellate review; sentencing options and sentencing practice and policy in relation to some common offences.
