This unit forms part of the Graduate Diploma in Legal Practice.
Introduction
This unit is organised in to three modules: familiarisation with the Court, Applications and Submissions (practice and advocacy) and conducted defended criminal proceedings. Throughout the duration of the Course a series of fortnightly exercises are distributed to trainees in the form of a factual scenario, set of instructions and relevant documentation. Trainees are required to act for their client on the information they are provided with. This includes filing relevant documentation with the Magistrates' Court and appearing in the Court to argue their clients application. Prior to each exercise trainees are given an on-site lecture relevant to their next exercise. Lectures are delivered by either a Magistrate or a senior practitioner experienced in the relevant area. All appearances are made at the Magistrates' Court in Hobart before a Magistrate.
The exercises cover the following areas:
- Adjournment without plea
- Bail application
- Pleas in mitigation
- Restricted licence applications
- Ex tempore (without preparation) exercises
- Ex parte restraint/family violence order application
- Application for bail for a charge of assault in the context of the Family Violence legislation
The final part of this unit is concerned with conducting defended criminal proceedings. The corresponding exercises concern the charges of common assault, and stealing. Trainees will appear for the defence or prosecution and will lead or cross examine a witness at the hearing. In addition to feed back by the presiding Magistrate a senior practitioner will observe and review trainees' Court appearances for the purposes of advocacy coaching and tuition.
